Rural Mondovi man hit with prison sentence for repeated assaults of girl

 

A 52-year-old Amish man from rural Mondovi was sentenced in Pepin County Court to five years in prison last week for repeated sexual assault crimes he admitted to committing about a decade ago.

Herman E. Nissley, W1764 Albany UU, had apologized to his family and church for assaulting a girl between 30-40 times when she was between the ages of four and six years old.

According to court reports, Pepin County Judge James Duvall received about 25 letters of support from Nissley’s wife and other family members. Many of them packed the viewing gallery during Nissley’s sentencing on Tuesday, Dec. 2. The letters said the Amish community had forgiven Nissley and noted they needed him more than he deserved to be incarcerated.

Duvall noted it was unfortunate that the focus of the sentencing hearing was on Nissley rather than his victims.

A complaint filed against Nissley in January indicates that Nissley told police he repeatedly exposed himself to two girls and had repeated sexual contact with them for about two years roughly 10 years ago.

The repeated nature of the assaults and the fact that Nissley kept silent until the girl confessed to the acts was appalling, Duvall said, noting one of the girls became an even greater victim when she was sent out of state for counseling while Nissley was allowed to stay.

The girl in question offered no opinion in a written letter as to what Nissley’s sentence should be.

Nissley stood up in church to confess to the assaults about a year ago, after which his conduct was officially reported to police, according to previous reports.

Records indicate the girl told family members about the assaults before Nissley  confessed in church.

Nissley also apologized in court for the acts, reportedly remarking that the incidents occurred during a “stressful time” in his life and he wasn’t sure why he committed the assaults.

Nissley faced a maximum of 80 years in prison for two felony counts of first-degree sexual assault of a child; two identical charges were read in and dismissed, according to court records.

District Attorney Jon Seifert recommended a seven-year prison sentence followed by 13 years of extended supervision for Nissley’s acts.

Defense attorney Harry Hertel pushed for probation and psycho-sexual treatment for his client, noting a prison setting would not be beneficial for Nissley. A stayed prison sentence for one of the felony counts and 15 years of probation for the other were also recommended by Hertel.

Duvall opted for a sentence somewhere in the middle. In addition to five years in prison, he placed Nissley on five years of extended supervision after his release from prison to be followed by 15 years of probation.
